Welcome to Locketi.com (the "Website"). The Website is owned and operated by Mažoji Bendrija Andora, registered in the Republic of Lithuania, hereafter referred to as the "Company," "we," "us," or "our". The purchase of any products from us is governed by the following Terms and Conditions ("Terms").

By accessing the Website and/or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not access the Website or purchase our Products.

1. AGREEMENT TO TERMS

By using our Website, you confirm that you have read, understood, and agree to be bound by these Terms. We reserve the right to modify these Terms at any time. We will indicate the date of the last revision at the top of this page. Your continued use of the Website after any such changes constitutes your acceptance of the new Terms.

2. PRODUCTS AND ORDERS

  • 2.1. Product Description: We strive to ensure that all details, descriptions, and images of our personalized fine jewellery ("Products") are as accurate as possible. However, we do not warrant that the descriptions are error-free.

  • 2.2. Personalization: You are solely responsible for the accuracy of all personalization details (e.g., text, images) you submit. We will produce the Product exactly as specified and are not liable for errors resulting from incorrect information provided by you. By submitting content for personalization, you represent that you have the legal right to use it.

  • 2.3. Order Acceptance: Your placement of an order does not constitute our acceptance of that order. We reserve the right to refuse or cancel any order for any reason, including suspicion of fraudulent activity. An order is only accepted by us upon shipment of the Product.

  • 2.4. Pricing and Payment: All prices are listed in the currency displayed at checkout. Shipping costs are additional. We reserve the right to correct any pricing errors and to cancel any orders arising from such errors.

3. SHIPPING, DELIVERY, TITLE, AND RISK OF LOSS

  • 3.1. Shipping: We ship worldwide. All shipping costs are calculated based on rates from our shipping providers and displayed at checkout.

  • 3.2. Title and Risk of Loss: Title to and risk of loss for the Products pass to you upon our delivery of the items to the shipping carrier. We are not liable for Products lost, damaged, or stolen after handover to the carrier. You are responsible for filing any claims with the carrier.

  • 3.3. Customs, Duties, and Taxes: For international orders, you are the importer of record and are responsible for all import duties, taxes, and customs fees levied by your country. These are not included in the purchase price.

4. RETURNS, REFUNDS, AND DEFECTS

  • 4.1. NO RIGHT OF WITHDRAWAL FOR PERSONALIZED GOODS: In accordance with Article 16(c) of the EU Directive 2011/83/EU on Consumer Rights and corresponding Lithuanian legislation, the statutory 14-day right of withdrawal does not apply to the purchase of our Products. All our lockets are personalized to your specific requirements and cannot be returned or refunded. All sales are final.

  • 4.2. Policy for Manufacturing Defects Apparent Upon Delivery: We stand by the quality of our craftsmanship. If you believe your Product has a manufacturing defect or does not conform to the specifications of your order, you must inspect the item upon receipt and contact us at info@locketi.com within seven (7) days of the delivery date. This policy is strictly limited to manufacturing defects present at the time of receipt.

    To make a claim under this policy, you must provide:

    • A detailed description of the alleged defect.

    • Clear photographs or video showing the defect on the unworn item, preferably taken immediately after unboxing.

    • Your order number.

    At our discretion, we may require you to return the Product for professional evaluation. If we confirm a manufacturing defect, our sole obligation will be to repair or replace the Product at our expense.

    This policy expressly excludes damage resulting from accident, customer misuse, improper storage, contact with chemicals, normal wear and tear, or any alteration made to the item after delivery. Evidence of wear or misuse will void any claim.

5. USER-GENERATED CONTENT (REVIEWS)

If you submit any content to our Website, such as product reviews ("User Content"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, publish, and display such User Content in any media for any purpose, including marketing.

6. PROHIBITED CONDUCT AND FRAUD PREVENTION

You agree not to engage in any fraudulent, abusive, or illegal activity, including initiating a payment chargeback without first contacting us to resolve the issue as outlined in Section 4.2. An improper chargeback is a breach of these Terms, and we reserve the right to dispute it and pursue legal action.

7. INTELLECTUAL PROPERTY

All content on this Website is the property of the Company or its content suppliers and is protected by Lithuanian and international copyright and trademark laws.

8. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

  • 8.1. Disclaimer: Except as expressly provided in Section 4.2, the Website and all Products are provided on an "as-is" basis. We make no additional warranties of any kind, while acknowledging your statutory rights under EU law.

  • 8.2. Limitation of Liability: To the fullest extent permitted by law, our total liability to you for any and all claims shall not exceed the amount you paid for the Product in question.

9. DISPUTE RESOLUTION AND GOVERNING LAW

  • 9.1. Governing Law: These Terms shall be governed by the laws of the Republic of Lithuania.

  • 9.2. For Consumers in the European Union: You have the right to address any dispute to the EU’s Online Dispute Resolution (ODR) platform, accessible at: http://ec.europa.eu/odr.

  • 9.3. For All Other Users: You agree that any dispute or claim will be resolved by binding arbitration in Vilnius, Lithuania, in the English language, rather than in court.

10. MISCELLANEOUS

  • 10.1. Severability: If any provision of these Terms is deemed unlawful or unenforceable, that provision shall be severable from these Terms and shall not affect the validity of any remaining provisions.

  • 10.2. Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and the Company.
